Electronic Records & Signature Consent

This Electronic Records & Signature Consent (this “Consent”) explains how Amend Solutions (“Amend,” “we,” “us,” or “our”) delivers records to you electronically and how you may use DocuMend, our electronic-signature engine, to create, send, and sign documents. Please read it carefully. By creating an account, using the Amend platform (the “Service”), using DocuMend, or clicking to accept, you agree to the terms below. This Consent supplements, and is incorporated into, our Terms of Service and Privacy Policy.

1. Consent to electronic records and signatures

By using the Service or DocuMend, you affirmatively consent to conduct business and transact electronically with Amend and, where applicable, with the other parties to your documents. Specifically, you agree that:

If our hardware or software requirements change in a way that creates a material risk that you will not be able to access or retain your Records, we will notify you and, if required by law, give you the opportunity to withdraw your consent without penalty.

4. Right to withdraw consent

You may withdraw your consent to receive account communications electronically at any time by emailing [email protected] with your name, account information, and a clear statement that you wish to withdraw consent. Your withdrawal is effective only after we have had a reasonable period of time to process it.

Because the Service and DocuMend are inherently electronic, withdrawing consent may limit, suspend, or end your ability to use electronic features or the Service altogether, and may prevent you from sending or completing documents through DocuMend. Withdrawal does not affect the legal validity or effect of Records provided or signed before the withdrawal took effect.

5. Requesting paper copies and updating your contact information

You may request a paper copy of any Record we have provided to you electronically by emailing [email protected]. We may charge a reasonable fee for producing and mailing paper copies, to the extent permitted by law. Requesting a paper copy does not, by itself, withdraw your consent to transact electronically.

You are responsible for keeping your contact information current. Please update your email address and other contact details in your account settings, or notify us at [email protected], so that we can continue to deliver Records to you.

6. Important limitation — DocuMend is a tool, not legal advice

DocuMend is a self-service software tool. It is not a law firm and does not provide legal advice. Amend does not review your documents and makes no representation or warranty about them. In particular:

Certain documents and transactions are excluded from ESIGN/UETA or are subject to special formalities and may require wet-ink signatures, notarization, or witnesses — for example, certain wills, codicils, and testamentary trusts; certain deeds and real-property conveyances; court filings and orders; adoption, divorce, and other family-law records; and notices relating to utilities, insurance, foreclosure, eviction, or product recalls. This list is not exhaustive. You should consult a qualified attorney to confirm what is required for your specific document.

7. Retention of your documents

Completed and signed documents, along with their audit trail, are stored in your Amend account and are accessible to you while your account remains active and in accordance with our Privacy Policy and Terms. You should download and keep your own copies of every completed document for your records. Amend is not a document-of-record or archival service, and we are not responsible for maintaining copies of your documents if your account is closed, suspended, or terminated.

8. Amend is not a party to your documents

Amend is a neutral technology provider. Except where Amend is expressly named as a party, Amend is not a party to any agreement, contract, or document you create, send, or sign through DocuMend, and takes no position on their terms. To the fullest extent permitted by law, Amend disclaims all liability for the validity, enforceability, interpretation, performance, breach, or any other consequence of your documents, and for any dispute between you and the other parties to them. This section is in addition to, and does not limit, the disclaimers and limitations of liability in our Terms of Service.

9. Changes to this Consent

We may update this Consent from time to time. If we make material changes, we will notify you by email or through the Service and update the “Last updated” date above. Your continued use of the Service or DocuMend after an update takes effect constitutes your acceptance of the revised Consent.
